The word culpa comes from the Latin "culpa" which means " fault or imputation ". This term can have different connotations, in the psychological aspect, guilt is defined as a feeling that people experience, and that originates as a result of an action that caused damage; bringing with it a sense of responsibility. This feeling can also be present when an event is intentionally omitted. Therefore, guilt is negligence or reckless action that harms another person, and that depending on the seriousness of the fact can cause a legal sanction.

In the context of law, guilt represents the act that causes damage and that leads to criminal or civil liability. A culpable crime is the omission of an act that brings legal consequences, the guilty person should have foreseen the consequences of the act, however, he did not proceed with the care he should have. It is important to note that guilt is very different from intent (willcommitting a crime, knowing the damage it can cause). In order to better capture the difference, this example is given: When a person has a weapon and operates it against another, knowing that it could hurt them, we are in the presence of an intent; Now, if an individual is cleaning his weapon and accidentally shoots himself and injures someone, in this case it would be his fault.

Guilt can be conscious and unconscious, when it is conscious, the consequences of the action were foreseen, but not desired by the person. When the blame is unconscious, on this occasion the consequences were not foreseen and much less wanted by the person.
