That an individual can be charged, a person who has a reportable attribution adjudicated for a crime committed with freedom, will, conscientiously and lucidity with which he himself has acted and acted. That he is accused of his conduct and acts that cause harm and discrimination with a clear intention on the facts, of full freedom, being held responsible for his fault; that legally speaking is the obligation to run, suffer, pay with the criminal consequences that the legal order indicates.

Any person of legal age with the possibility of a mental condition being imputable, not suffering from any mental disability, disorder, deficiency or psychological abnormality, who cannot be held responsible or fend for himself, nor is he in his right mind to answer for his crimes.
On the contrary to these, in order to be unimpeachable, it must be demonstrated that there is a disability, which makes it not recognize that it has committed a crime, finding itself as a serious disturbance of consciousness or mental by not recognizing reality and not having the ability to think for alone, as from a degenerative mental illness or, failing that, a minor who lacks knowledge of duty if they are not ordered.
Thus referring to the set of physical, mental, maturity, mental or health conditions in general that are required to be legally tried by law, referring to the author of the crime but not to the crime itself. Taking into account these cases , a diminished responsibility can be reached when, in a way, a person's understanding of their actions is incomplete. All this so that a judge can determine the responsibility of an individual for an illegal act, combining two conditions, intelligence or discernment where it is understood what is good and what is bad and the free will or freedom that is chosen between these two.
