What is equity? »Its definition and meaning

Anonim

The term Equity is widely used in law, it comes from the Latin “ aequĭtas” , since it is a basis for establishing the parameters on which justice works. Many confuse justice with equity, but what is true is the precept established by the Jurisconsult Ulpiano in which he asserts that equity is nothing more than the intention of giving everyone what they deserve. From here, the need arises to grant society an establishment of norms so that they comply with them in order to comply with equity and therefore with justice.

The compendium of laws under which man develops social life are based on the writings and precepts established in history, in the customary of his reason for being and in the evolution of life in society. Equity serves to give that balanced context to a moral, civil and constitutional equation that man must respect to maintain order. If there were no equity, there would not be that balance between all human beings, beyond the awareness that man can have of what corresponds to him, in his nature there is a social correspondence that equates him with any other.

Does equity define a dominion over man above his own interests ? The answer is no, the man endowed with free will corrupts the purpose of equity in many aspects, however the mass of the population remains stable, docile to the commandment of an order designed based on laws and regulations that allow each person be given what corresponds, that each one pays the consequences of their actions and that the compensation necessary to follow the course of the social current to which they belong is received for any damage or prejudice.

Equity today is a more complex issue, according to the evolution of man in society and what nature has turned for its own good, the concept would be extended significantly if we analyze the equity of man with the environment environment, since the damage that man has done to his environment is impossible to equate with what nature could have done to man.
