It is nothing more than the legal link that an individual has with a State. This link gives rise to certain rights and obligations between the aforementioned parties. Nationality is used to determine the place of origin of a person, it also serves to identify the place of origin of a ship, plane, car, among others. One of these acquired rights is the protection that the State must grant to a person in the event of a diplomatic problem.
The bond of nationality is regulated in part, by the constitutions of the different countries, which are responsible for establishing the limits of said nationality, all this without interfering with the international laws already established. In the case of a foreign person who wants to opt for nationality, of a specific country, they must be governed by the constitutional laws of that country and go through the tests that it establishes. Countries have every right to say whether or not a person deserves nationality.
On the other hand, a country may consider a person “stateless”, that is, it takes away their nationality. This case only occurs if the government proves to the IACHR that the individual broke the laws already established within the Constitution of the corresponding nation. This term is also used when one person does not accept another as a member of the country. For example, the Constitution of the Bolivarian Republic of Venezuela establishes that nationality is an irrevocable right and that this bond can be passed on for up to three generations, that is, one is Venezuelan until the last day.
